These AI Opportunity Assessment Terms ("Terms") govern your purchase of an AI Opportunity Assessment from AI-Untapped ("AI-Untapped," "we," "us," or "our"). By purchasing the assessment, you agree to these Terms. If you purchase on behalf of a company, you represent that you have authority to bind that company to these Terms.
1. Assessment Service
The AI Opportunity Assessment is a fixed-scope business and technical review designed to identify practical AI, automation, and workflow improvement opportunities for your business. The assessment may include an intake process, structured discovery questions, review of information you provide, an engineer-reviewed findings report, and a strategy review meeting, as described on the website or checkout page.
The assessment is advisory only. It does not include building, implementing, deploying, integrating, monitoring, maintaining, or operating any AI system, automation, software integration, agent, workflow, or third-party tool unless a separate written agreement says otherwise.
2. Separate Implementation Terms
Any implementation, managed AI service, custom software development, integration work, employee training, ongoing support, monitoring, or maintenance is outside the assessment purchase and requires a separate written scope, proposal, statement of work, subscription agreement, or other written approval. Assessment recommendations are not a commitment that AI-Untapped will implement any recommendation at a particular price, timeline, or outcome.
3. Business Customers Only
The assessment is intended for business use. You agree that the purchase is made for commercial or professional purposes and not primarily for personal, family, or household use.
4. Customer-Provided Information
The quality and usefulness of the assessment depend on the information made available to AI-Untapped. The assessment is based on the workflows, systems, goals, constraints, costs, bottlenecks, current tools, and other business context shared during the assessment process. AI-Untapped may rely on that information without independently verifying every fact, number, system detail, or business assumption.
If information is incomplete, inaccurate, outdated, unavailable, delayed, withheld, or later changes, the assessment may be incomplete, less useful, inaccurate, or no longer applicable. AI-Untapped is not responsible for poor, incomplete, or inaccurate recommendations to the extent they result from incomplete, inaccurate, outdated, unavailable, withheld, or changed information.
5. Not Regulated Professional Advice
AI-Untapped does not provide legal, tax, accounting, investment, financial, HR, employment, medical, insurance, cybersecurity audit, or compliance advice. Any discussion of those topics is for general business planning context only. You are responsible for consulting qualified professionals before relying on assessment findings in regulated, sensitive, or high-consequence areas.
6. No Guaranteed Results
The assessment may include estimates, prioritization, expected benefits, potential savings, possible ROI, complexity ratings, costs, effort ranges, timelines, or feasibility opinions. These are planning estimates only and are not guarantees. Actual results depend on your systems, data quality, operational complexity, vendor limitations, team adoption, implementation choices, security requirements, and other factors outside AI-Untapped's control.
7. AI and Technical Limitations
AI tools, AI-assisted analysis, and AI-generated outputs can be inaccurate, incomplete, biased, outdated, or misleading. AI-Untapped may use AI-assisted tools internally to organize information, draft materials, or support analysis, but recommendations are reviewed with human engineering judgment before delivery. Assessment findings should be reviewed and validated before being used for business decisions.
8. Deliverables
Unless otherwise stated in writing, assessment deliverables are limited to the assessment materials described at purchase, such as a written report, roadmap, findings summary, recommendation list, and strategy meeting. Drafts, internal notes, raw prompts, internal analysis files, working papers, and intermediate materials are not included unless expressly agreed in writing.
9. Scheduling and Client Participation
The assessment process may include intake questions, discovery meetings, review periods, and a strategy meeting. Missed meetings, late responses, unavailable personnel, or incomplete intake materials may delay delivery or reduce the usefulness of the assessment. AI-Untapped may reschedule meetings or delivery dates when reasonably necessary.
10. Fees, Payment, and Taxes
Assessment fees are due at checkout or as stated on an invoice or written order. You authorize AI-Untapped and its payment processors to charge the selected payment method for applicable fees. Unless stated otherwise, fees are in U.S. dollars and do not include taxes, duties, bank fees, or payment processing charges, which are your responsibility where applicable.
11. Refunds, Cancellation, and Rescheduling
Because the assessment reserves professional time and may begin shortly after purchase, fees are non-refundable once work has begun unless AI-Untapped agrees otherwise in writing. If you request cancellation before work begins, AI-Untapped may, at its discretion, provide a refund minus any payment processing fees or administrative costs already incurred.
If AI-Untapped cancels the assessment before work begins and does not offer a reasonable substitute date or service, your exclusive remedy is a refund of the amount paid for the cancelled assessment.
12. Confidentiality
Each party may receive non-public business, technical, financial, operational, customer, employee, or strategic information from the other party. The receiving party will use reasonable care to protect confidential information and will use it only to perform or receive the assessment. Confidentiality obligations do not apply to information that is public, already known without restriction, independently developed, rightfully received from another source, or required to be disclosed by law.
13. Sensitive Information
Do not submit highly sensitive, regulated, personal, customer, employee, payment, health, legal, credential, security, trade-secret, or export-controlled information unless an appropriate handling process has been agreed in writing. AI-Untapped assumes that materials submitted for the assessment may be reviewed for assessment purposes unless you identify restrictions in writing before submission.
Do not provide passwords, API keys, private tokens, or credentials through email, chat, intake forms, or shared documents unless AI-Untapped specifically provides an approved secure method.
14. Intellectual Property
You retain ownership of your pre-existing materials, data, brand assets, business information, and confidential information. AI-Untapped retains ownership of its pre-existing materials, templates, methods, know-how, prompts, internal processes, reusable analysis frameworks, training materials, and general expertise.
Upon full payment, AI-Untapped grants you a non-exclusive, non-transferable license to use the final assessment deliverables prepared specifically for you for your internal business purposes. You may not resell, publish, sublicense, or commercialize AI-Untapped's templates, assessment format, methods, training materials, or reusable frameworks without written permission.
15. Publicity
AI-Untapped will not publicly identify you as a customer, use your logo, or publish case-study details without your permission. You may not use AI-Untapped's name, logo, or materials in public statements, advertising, or endorsements without our permission.
16. Acceptable Use
You may not use the assessment, services, or deliverables to violate law, infringe rights, mislead customers, discriminate unlawfully, generate spam, bypass security controls, create malware, misuse confidential data, impersonate others, or make automated decisions in high-impact areas without appropriate human review, professional review, and legal compliance controls.
17. Warranties Disclaimer
The assessment and deliverables are provided "as is" and "as available" to the fullest extent permitted by law. AI-Untapped disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and error-free performance.
18. Limitation of Liability
To the fullest extent permitted by law, AI-Untapped will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages, or for loss of data, revenue, goodwill, business opportunity, or business interruption, even if advised of the possibility of those damages.
To the fullest extent permitted by law, AI-Untapped's total liability for any claim related to the assessment will not exceed the amount you paid to AI-Untapped for the assessment giving rise to the claim.
19. Indemnification
You agree to defend, indemnify, and hold harmless AI-Untapped from claims, damages, liabilities, costs, and expenses arising from your misuse of the assessment or deliverables, your violation of these Terms, your violation of law or third-party rights, materials or data you provide, or business decisions you make based on the assessment.
20. Governing Law and Venue
Unless a signed agreement states otherwise, these Terms are governed by the laws of the State of California, without regard to conflict of law rules. The parties consent to exclusive jurisdiction and venue in state or federal courts located in California for disputes arising from these Terms or the assessment.
21. Changes to Terms
AI-Untapped may update these Terms from time to time. Updated Terms apply to new purchases after the updated effective date. Changes will not retroactively alter an assessment already purchased unless both parties agree.
